DOCTOR RIGHTS:
1. Right to Adhere to Ethical Principles While Practicing Their Profession:
A doctor may conflict with legal, political, social, aesthetic and economic values while practicing their profession. The doctor has the right to make free and independent decisions when resolving this conflict.
2. Right to Allocate Sufficient Time:
A doctor has the right to request sufficient time for the patient to show the necessary care, to record information and documents in a good manner, and to provide information about the patient's illness.
3. Right to Reject the Patient:
Except for emergency aid, official or humanitarian duty, in the event that the trust relationship between the patient and the patient is damaged, the doctor has the right to reject the patient or leave the treatment incomplete.
4. Right Not to Guarantee Recovery:
A doctor makes a diagnosis in accordance with scientific requirements and applies the necessary treatment. The concludes the treatment they have started, completes the deficiencies, and follows up on the patient until they recover. Since these studies do not result in a cure, they cannot be criticized from a deontological perspective.
5. Right to Choose the Treatment Method:
If more than one treatment method can be applied at the same time in the treatment of a disease, the doctor has the right to choose the one he/she wishes.
6. Right to Consult:
In matters that are within or outside his/her area of expertise, the patient has the right to request consultancy (advisory) from another doctor (s) for his/her benefit on medical, ethical and legal grounds.
7. Right to Benefit from Contemporary Scientific Medical Opportunities and Use in Professional Practices:
It is the right of a doctor who has been introduced to the application areas of high technology in his/her education to want to experience the developments in diagnosis and treatment in his/her professional life. The physician may refer his/her patient to a center that is more technologically advanced.
8. Right to Practice His/her Profession Without Being Under Pressure:
In professional practice, the doctor has the right to reject any pressure attempts that may prevent the provision of the clinical freedom that he/she requires. In this case, which can cause problems especially in the field of forensic medicine, the physician can apply to the Public Prosecutor's Office.
9. The Right to Avoid Situations Contrary to Their Values:
In a relationship where the patient's values are respected, the doctor can also defend their own values. A physician should not be forced into practices that are contrary to their own values.
10. The Right to Protect Their Health:
A doctor has the right to demand working conditions that will minimize health risks while practicing their profession.
11. The Right to Request an Adequate Income Level:
Following developments in the medical profession requires a certain price. Legally, the doctor must adequately train themselves in line with the development of the country's medicine. This requires doctor to allocate a certain share of their budgets for book purchases, journal subscriptions and congress participation. The services they provide, which require extensive professional knowledge and intensive labor and are also risky, should be paid for.
12. Right to Participate in Administrative Processes:
Doctor have the right to be effective in administrative processes in the institutions they work in and the country they live in, and to express their opinions on health-related legislation.
13. Right to Withdraw from Testimony:
Doctor have the right to withdraw from testifying in legal cases, in cases where professional secrecy is at stake (Civil Procedure Code (CCP) 245/4, Criminal Procedure Code (CMUK) Article 48).
DOCTOR RESPONSIBILITIES:
1. Responsibility to Protect Human Life:
He/she is responsible for protecting and ensuring the continuation of human health.
2. Responsibility to Act in Accordance with Professional Ethics Rules:
He/she is responsible for acting in accordance with ethical rules both when performing his/her duties arising from the patient-doctor relationship and when performing medical interventions on patients.
3. Responsibility to Care for Patient Rights:
He/she is responsible to care for the rights of his/her patient, primarily because he/she is a human being, and the rights arising from the Patient Rights Agreement.
4. Personal Act Responsibility:
He/she is responsible to apply medical intervention to his/her patient in accordance with the rules accepted by law and medical science.
5. Responsibility to Take Anamnesis and Perform Examination:
The examination he/she performs for the purpose of diagnosing the patient should include current and previous diseases and the medications he/she uses. The doctor is responsible to take the patient's anamnesis data into consideration when planning treatment.
6. Responsibility to Make a Diagnosis:
He/she is responsible to diagnose his/her patient after taking the anamnesis and performing the examination.
7. Responsibility to Choose the Appropriate Treatment:
He/she is responsible to determine the most appropriate treatment method for his/her patient as a result of his/her professional knowledge and experience, the anamnesis he/she takes, the examination and tests he/she performs.
8. Responsibility for Not Giving a Recovery Guarantee to Patients and Patient Relatives:
A doctor does not give a guarantee due to the medical practices he/she applies.
9. Responsibility for Informing and Obtaining Consent:
A doctor is responsible for informing his/her patient about the intervention he/she will perform and the complications of the intervention, and for obtaining consent from his/her patients for treatment.
10. Responsibility for Loyalty and Care:
A dentist shall prioritize the interests of his/her patient over his/her own interests, shall not harm his/her patient, shall
